รายงานผลการดำเนินงานสำคัญปีพ.ศ.2556กรมทรัพย์สินทางปัญญา
1. การเตรียมความพร้อมด้านทรัพย์สินทาง ปัญญาเพื่อเข้าสู่ประชาคมอาเซียน ดังนี้
(1) เข้าร่วมประชุมคณะทำ งานความร่วมมือด้าน ทรัพย์สินทางปัญญาอาเซียน (AWGIPC) ซึ่งเป็นการ ประชุมระดับหัวหน้าสำ นักงานทรัพย์สินทางปัญญาอาเซียน เพื่อหารือในการดำ เนินกิจกรรมภายใต้แผนปฏิบัติการด้าน ทรัพย์สินทางปัญญาอาเซียน เช่น การแลกเปลี่ยนแผนการ ตรวจสอบสิทธิบัตรภายใต้โครงการ ASPEC เป็นต้น โดยใน ปี 2556 เข้าร่วมประชุมจำ นวน 3 ครั้ง คือ ครั้งที่ 39 ณ เมือง บันดุง ประเทศอินโดนีเซีย ครั้งที่ 40 ณ เมืองหลวงพระบาง สาธารณรัฐประชาธิปไตยประชาชนลาว และครั้งที่ 41 ณ จังหวัดเชียงใหม่
(2) เข้าร่วมประชุมหัวหน้าสำ นักงานทรัพย์สินทาง ปัญญาอาเซียน-ญี่ปุ่น เพื่อติดตามความคืบหน้าและผลการ ดำ เนินงานด้านทรัพย์สินทางปัญญาภายใต้แผนปฏิบัติการ ด้านทรัพย์สินทางปัญญาอาเซียน-ญี่ปุ่น (ASEAN-Japan IPR Action Plan 2012-2013) ปี 2555-2556 และวางแผน กิจกรรมที่จะดำ เนินการในอนาคตตามร่างแผนปฏิบัติการด้านทรัพย์สินทางปัญญาอาเซียน-ญี่ปุ่น (ASEAN-Japan IPR Action Plan 2014-2015) ปี 2557-2558
(3) จัดประชุมด้านทรัพย์สินทางปัญญาไทย – สหภาพยุโรป (Thai – EU IPR Dialogue) ครั้งที่ 3 เพื่อหารือ ในการดำ เนินความร่วมมือด้านทรัพย์สินทางปัญญาระหว่าง อาเซียนกับประชาคมยุโรป (The EU-ASEAN Intellectual Property Rights Cooperation Programme: ECAP II) มีหน่วย งานเข้าร่วมประชุม เช่น สำ นักงานอัยการ ฝ่ายคดีทรัพย์สิน ทางปัญญาและการค้าระหว่างประเทศ กองบังคับการ ปราบปรามการกระทำ ความผิดเกี่ยวกับอาชญากรรมทาง เศรษฐกิจ และกรมศุลกากร เป็นต้น
(4) การเข้าร่วมจัดงานเสวนา ภายใต้ชื่องาน “อนาคตเศรษฐกิจไทย ภายใต้ประชาคมอาเซียน” ณ ศูนย์ราชการเฉลิมพระเกียรติ 80 พรรษา จัดโดยกรมเจรจา การค้าระหว่างประเทศ ซึ่งกรมทรัพย์สินทางปัญญาได้เข้า ร่วมจัดงานเสวนา ใน 2 หัวข้อ ดังนี้
– เรื่อง “ก้าวสู่ AEC คุณลืม IP หรือไม่” เมื่อวันที่ 1 พฤศจิกายน 2556 โดยมีผู้เชี่ยวชาญด้านการส่งเสริม การตลาดสินค้าและบริการส่งออกของไทย และผู้ประกอบการ ไทยที่มีประสบการณ์ดำ เนินธุรกิจในประเทศอาเซียน ได้แก่ บริษัท ปูนซิเมนต์ จำ กัด (มหาชน) บริษัท และบริษัท เอพลัส ซัพพลาย จำ กัด ร่วมเป็นวิทยากร เพื่อเพิ่มพูนความเข้าใจ ในการเตรียมความพร้อมด้านทรัพย์สินทางปัญญารองรับ การเข้าสู่ประชาคมอาเซียน โดยมีผู้เข้าร่วมเสวนา จำ นวน 200 คน ประกอบด้วย หน่วยงานภาครัฐ ภาคเอกชน อาจารย์ นักศึกษา และประชาชนทั่วไป
– เรื่อง “บันเทิงไทยสีสันใหม่ของอาเซียน” เมื่อวันที่ 5 พฤศจิกายน 2556 โดยมีวิทยากร ได้แก่ คุณปรัชญา ปิ่นแก้ว ผู้กำ กับภาพยนตร์ชั้นนำ ของประเทศ และคุณลักษมณ์ เตชะวันชัย รองนายกสมาพันธ์สมาคมดิจิทัลบันเทิงแห่ง ประเทศไทย เพื่อให้ความรู้และแลกเปลี่ยนข้อคิดเห็นเกี่ยว กับโอกาสทางการตลาดและแนวทางการดำ เนินธุรกิจบันเทิง ไทยให้สามารถเติบโตและแข่งขันได้ในตลาดอาเซียน โดยมีผู้ เข้าร่วมเสวนา จำ นวน 150 คน ประกอบด้วย เจ้าของผลงาน อันมีลิขสิทธิ์ อาจารย์ นักศึกษา และหน่วยงานที่เกี่ยวข้อง
(5) จัดสัมมนาระดับภูมิภาค เรื่อง “การเข้าถึง ข้อมูลทางทรัพย์สินทางปัญญาสำ หรับผู้ประกอบการ วิสาหกิจขนาดกลางและขนาดย่อม (SMEs Smart Track to IP Information)” ซึ่งเป็นไปตามแผนการดำ เนินงาน ทรัพย์สินทางปัญญาระหว่างอาเซียนและญี่ปุ่น (ASEAN – Japan) โดยการแลกเปลี่ยนประสบการณ์ของการเข้าถึง ข้อมูลข่าวสารทางทรัพย์สินทางปัญญาสำ หรับผู้ประกอบการ SMEs มีผู้เข้าร่วม จำ นวน 50 คน
(6) จัดสัมมนา The Consultation Seminar on Accession to the Madrid Protocol เพื่อสร้างความรู้ความ เข้าใจ และเผยแพร่ข้อมูลการจดทะเบียนเครื่องหมายการค้า ระหว่างประเทศภายใต้ระบบพิธีสารมาดริด (Madrid Protocol) ให้แก่ผู้ประกอบการ เจ้าของเครื่องหมายการค้า ตัวแทนรับจดทะเบียนเครื่องหมายการค้า และประชาชน ผู้สนใจ มีผู้เข้าร่วม จำ นวน 50 คน
(7) จัดสัมมนา ในหัวข้อ “บุกตลาดอาเซียนด้วย ทรัพย์สินทางปัญญา” รวม 8 ครั้ง มีผู้เข้าร่วมงานรวม 1,043 คน เพื่อสร้างความรู้ความเข้าใจเกี่ยวกับขั้นตอน และกระบวนการยื่นคำ ขอจดทะเบียนทรัพย์สินทางปัญญา ในกลุ่มประเทศอาเซียน โดยเชิญผู้เชี่ยวชาญจากประเทศ ฟิลิปปินส์ อินโดนีเซีย มาเลเซีย บรูไนดารุสซาลาม สิงค์โปร์ กัมพูชา สาธารณรัฐประชาธิปไตยประชาชนลาว เวียดนาม และสาธารณรัฐแห่งสหภาพเมียนมาร์ ให้ความรู้แก่ผู้ ประกอบการ หน่วยงานภาครัฐและเอกชนของไทย
(8) จัดสัมมนาเชิงปฏิบัติการ เรื่อง “WIPO-ASEAN Workshop on Copyright and Orphan Works” ณ กรุงเทพ โดยกรมทรัพย์สินทางปัญญา ร่วมกับองค์การทรัพย์สินทางปัญญาโลก (WIPO) เพื่อให้ความรู้ความเข้าใจเกี่ยวกับระบบ การบริหารจัดการงานลิขสิทธิ์ที่หาเจ้าของไม่ได้ และให้ความ เป็นธรรมแก่เจ้าของลิขสิทธิ์และผู้ใช้งาน Orphan Works ของกลุ่มประเทศอาเซียน อันเป็นการลดความเสี่ยงจากการ ละเมิดลิขสิทธิ์ และเพิ่มโอกาสในการเข้าถึงและใช้ประโยชน์ จากงานลิขสิทธิ์ มีผู้สนใจเข้าร่วมสัมมนา จำ นวน 85 คน
Work of Particular Importance in 2013 Undertaken by the Department of Intellectual Property
1. Preparedness in the Sphere of Intellectual Property towards the ASEAN Community
(1) Meetings of the ASEAN Working Group on Intellectual Property Co-operation (AWGIPC). The Department of Intellectual Property attended the meetings of the AWGIPC, at which heads of intellectual property agencies in ASEAN met for discussing activities to be undertaken under the ASEAN Intellectual property action plan, for instance, the exchange of patent examination plans under the ASEAN Patent Examination Co-operation (ASPEC) programme. In 2013, three such meetings were attended –the 39th Meeting in Bundung, the 40th Meeting in Luang Prabang, Lao PDR and the 41st Meeting in Chiang Mai.
(2) ASEAN-Japan Heads of Intellectual Property Offices Meeting. The Department of Intellectual Property attended this meeting for following up the progress and results of work operation in the sphere of intellectual property under the ASEAN-Japan IPR Action Plan 2012-2013 and also for planning future activities to be undertaken under the draft ASEAN-Japan IPR Action Plan 2014-2015.
(3) Third Thai-EU IPR Dialogue. The Department of Intellectual Property organised the Third Thai-EU IPR Dialogue for discussing the EU-ASEAN Intellectual Property Rights Co-operation Programme (ECAP II). This Dialogue was attended by representatives of several agencies such as the Office of the Attorney-General (Intellectual Property and International Trade Section), the Economic Crime Division (ECD) and the Customs Department.
(4) IP Talks. The Department of Intellectual Property organised talks related to intellectual property as part of the “Future of Thai Economy under the ASEAN Community” event held by the Department of Trade Negotiations at the Government Complex Commemorating His Majesty the King’s 80th Birthday Anniversary. Talks organised by the Department were on 2 topics as follows.
“Do you forget IP as we are moving towards the AEC?”, held on 1st November 2013. The talk was joined, as speakers, by experts in the area of market promotion of exported goods and services of Thailand and also by Thai traders experienced in carrying out business in ASEAN countries, namely, Siam Cement Public Company Limited and A-Plus Supply Co. Ltd. It was intended to be a forum for fostering understanding in IP preparedness for moving towards the ASEAN Community. This talk was attended by 200 people from public and private agencies, the academia and the general public.
– ”Thai Entertainment: New Charm for ASEAN”, held on 5th November 2013. Speakers for this talk included Mr. Prachya Pinkaew, the leading film director of Thailand and Mr. Luk Techawanchai, Deputy President of the Thai Digital Entertainment Content Federation. The talk was intended to disseminate knowledge and exchange opinions on market opportunities and ways to operate Thai entertainment business in the hope that this line of business would grow and become competitive in the ASEAN market. This event was participated by 150 people – copyright owners, teachers, students and representatives of agencies concerned.

(6) Consultation Seminar on Accession to the Madrid Protocol. This Seminar was intended to disseminate information on international registration of trademarks under the Madrid Protocol to entrepreneurs, trademark owners, trademark attorneys and general members of the public and was attended by 50 participants.
(7) Seminar on “Penetrating the ASEAN Market through Intellectual Property”. The Department of Intellectual Property organised a seminar on “Penetrating the ASEAN Market through Intellectual Property” on 8 occasions, with 1,043 participants, for promoting knowledge and understanding in connection with steps and procedures involving application for registration of intellectual property in ASEAN countries. Experts from the Philippines, Indonesia, Malaysia, Brunei Darussalam, Singapore, Cambodia, Lao PDR, Vietnam and Myanmar were invited as speakers in the interest of entrepreneurs as well as public and private agencies in Thailand.
(8) WIPO-ASEAN Workshop on “Copyright and Orphan Works”. This workshop was organised by the Department of Intellectual Property in collaboration with the World Intellectual Property Organisation (WIPO) for promoting knowledge and understanding in relation to schemes for administering orphan works and how to do justice to copyright owners as well as users of orphan works in ASEAN countries in an attempt to reduce copyright-infringement risks and also for enhancing opportunity to access and exploit copyrighted works. This workshop was attended by 85 participants.
