กรมได้ดำ เนินการพัฒนาระบบบริหารงานจดทะเบียน เครื่องหมายการค้าใหม่ โดยนำ ระบบเทคโนโลยีสารสนเทศ มาใช้ทั้งระบบเพื่อทดแทนระบบเดิมทั้งหมด โดยปรับ เปลี่ยนกระบวนงานต่างๆ ที่เป็นอุปสรรคในการปฏิบัติงาน ให้การรับจดทะเบียนเครื่องหมายการค้ารวดเร็วยิ่งขึ้น โดยพัฒนากระบวนงาน ขั้นตอนการจดทะเบียน การปรับปรุง ฐานข้อมูลใหม่ให้เข้าสู่รูปแบบอิเล็กทรอนิกส์ การจดทะเบียน สามารถดำ เนินการได้โดยไม่ต้องรอจัดทำ แฟ้มทะเบียน การเบิกจ่ายแฟ้มคำ ขอ การสั่งการต่างๆ ของนายทะเบียน สามารถบันทึกข้อมูลลงระบบได้ทันที ทำ ให้การจดทะเบียน เครื่องหมายการค้ามีความสะดวกและรวดเร็วมากขึ้น
ระบบงานแบบใหม่นี้มีรูปแบบการทำ งานที่สำ คัญ ได้แก่ ระบบยื่นคำ ขอ/คำ ร้องผ่านทางอินเตอร์เน็ต (e-Filing) ระบบการชำ ระเงินค่าธรรมเนียมผ่านธนาคาร (e-Payment) รองรับการทำ งานที่บ้านของเจ้าหน้าที่ (Work at Home) ระบบไร้กระดาษ (paperless) ระบบลายเซ็นอิเล็กทรอนิกส์ (e-Signature) และสามารถเชื่อมโยงฐานข้อมูลกับสำ นักงาน เครื่องหมายการค้าในประเทศต่างๆ เป็นต้น
การพัฒนาระบบบริหารงานจดทะเบียนเครื่องหมาย การค้าแบบใหม่นี้ เรียกได้ว่าเป็นการพลิกโฉมรูปแบบ การทำ งาน และช่วยให้เกิดประโยชน์ต่อประชาชน เจ้าหน้าที่ และการบริหารงานจดทะเบียนเครื่องหมายการค้า ในภาพรวม
ประโยชน์ที่ประชาชนจะได้รับจากระบบบริหารงาน จดทะเบียนเครื่องหมายการค้า ได้แก่ การให้บริการยื่นคำขอ/ คำ ร้อง เกี่ยวกับการจดทะเบียนเครื่องหมายการค้าผ่าน ทางอินเตอร์เน็ต (e-Filing) ได้อีกช่องทางหนึ่ง จากเดิมที่ต้องยื่นคำ ขอจดทะเบียนโดยตรงที่กรมทรัพย์สิน ทางปัญญา หรือยื่นผ่านสำ นักงานพาณิชย์จังหวัดต่างๆ โดยสามารถใช้บริการได้ที่เว็บไซต์กรมทรัพย์สินทางปัญญา www.ipthailand.go.th เลือกหัวข้อ บริการออนไลน์ -> ระบบ จดทะเบียนเครื่องหมายการค้า (e-Filing) สำ หรับประชาชน และสมัครสมาชิกเพื่อกำ หนด Username และ Password เข้าใช้งาน ระบบจะแจ้งผลการสมัครทาง e-mail ที่ระบุ ในการสมัครเข้าใช้งานทันที ผู้สมัครต้องเข้าไปยืนยันตัวตน และเข้าสู่ระบบได้ทันที
นอกจากนี้ยังสามารถสืบค้นและตรวจสอบ ความเหมือนคล้ายเครื่องหมายการค้าที่เป็นรูป คำ รวมทั้ง การติดตามสถานะการจดทะเบียน ผ่านทางอินเตอร์เน็ต ได้สะดวกรวดเร็วขึ้นโดยไม่ต้องเสียเวลาและค่าใช้จ่ายใน การเดินทางมาที่กรม ซึ่งปัจจุบันกรมทรัพย์สินทางปัญญา ให้บริการสืบค้นเครื่องหมายการค้าผ่านระบบออนไลน์โดย ไม่เสียค่าใช้จ่าย จากเดิมจะต้องเสียค่าธรรมเนียม 100 บาท/ ชั่วโมง
ในส่วนของการปฏิบัติงานของเจ้าหน้าที่นั้น กระบวน งานทั้งหมด ตั้งแต่ การตรวจสอบความเหมือนคล้าย การพิจารณาสั่งการ การประกาศโฆษณา การคัดค้าน การอุทธรณ์ การออกหนังสือสำ คัญ การจดทะเบียน เปลี่ยนแปลง และการดำ เนินการอื่นๆ ที่เกี่ยวข้อง จะอยู่ ในรูปแบบของระบบไร้กระดาษ (paperless) และสามารถ รองรับการทำ งานที่บ้าน (Work at Home) เจ้าหน้าที่สามารถ ใช้ระบบจากที่บ้านได้และสามารถปฏิบัติงานโดยไม่จำ กัดเวลาและสถานที่ รวมทั้งมีระบบการออกหนังสือแจ้งผล การจดทะเบียนและการออกหนังสือรับรองการจดทะเบียน โดยใช้ระบบลายเซ็นอิเล็กทรอนิกส์ (E-Signature)
นอกจากนี้ ระบบฐานข้อมูลสามารถเชื่อมโยง และแลกเปลี่ยนข้อมูลกับสำ นักงานเครื่องหมายการค้า ต่างประเทศ องค์การทรัพย์สินทางปัญญาโลก (WIPO) ประชาคมเศรษฐกิจอาเซียน (AEC) และรองรับการปฏิบัติ งานเกี่ยวกับการจดทะเบียนเครื่องหมายการค้าระหว่าง ประเทศตามพิธีสารมาดริดได้ (Madrid Protocol) รวมทั้งมี ระบบสำ รองเพื่อป้องกันกรณีฉุกเฉินหรือภัยพิบัติ (DR-Site) เพื่อให้การบริการมีเสถียรภาพ และให้บริการอย่างต่อเนื่อง
กรมทรัพย์สินทางปัญญา หวังเป็นอย่างยิ่งว่า การนำ ระบบบริหารงานจดทะเบียนเครื่องหมายการค้า แบบใหม่นี้ จะช่วยให้เจ้าของเครื่องหมายการค้าและ ประชาชนทั่วไปได้รับความสะดวก รวดเร็ว ตลอดจนลด ค่าใช้จ่ายในการเดินทาง และทำ ให้การบริการของกรมฯ เข้าสู่ระบบรัฐบาลอิเล็กทรอนิกส์ฯ (e-government) ที่ช่วย เพิ่มประสิทธิภาพการทำ งานให้กับภาครัฐและประชาชน ต่อไป
Trademark Registration in New Perspective
The Department of Intellectual Property has recently introduced a revolutionary change to the trademark registration management system by overhauling the entire information system used to facilitate day-to-day operations related to registration of trademarks. With the new information system, the outdated, redundant, inefficient workflow processes were eliminated to shorten the time required for registering trademarks. The overall workflow system and registration process were revised and improved, and the database was converted and transferred into electronic format. With capabilities enabled by advanced IT system, the registration can now be carried out at once without wasting time on the obsolete step involving manual preparation of register files, as the old system required. Internal application retrieval requests and the Registrar’s instructions can be quickly processed through this new information system which allows users to key in and save the information related to requests, instructions, etc. immediately. This certainly makes the whole process of trademark registration considerably more convenient and timely.
The new electronic-based workflow system consists of several significant modules as follows:- e-Filing of Applications/Requests, e-Payment via bank, paperless module, and e-Signature module. The new IT system is designed to support work-at-home feature, allowing the Department’s officials to perform their trademark-related tasks even though they are not physically at their offices. The new database enables users to create networks and connection with other IP offices in foreign countries.
The development of trademark registration management system on the basis of advanced IT system is regarded as a revolutionary new way of working which is beneficial to the public, the Department’s officials and employees, and the overall aspects of trademark registration management.
To explain in details the advantages to the public of the new management and workflow system, the applicants are now able to file trademark applications/ requests via E-filing in addition to the customary method that requires the submission of application-related documents directly to the Department of Intellectual Property in Bangkok or the Provincial Commercial Offices located in other provinces. To use the E-filing feature, the applicants just visit the Department’s website at www. ipthailand.go.th, then select the tab Online Services ➜ Trademark e-filing. The website users could subscribe the website membership which will require each individual user to set his/her username and password for log-in. The system will immediately send a reply message informing the subscriber of the subscribing membership result/status to the subscriber’s e-mail address. Then, the subscriber will be able to immediately proceed with the verification and getting an access to the system.
Furthermore, the system also allows the member users to search and inspect trademark visual images kept in the Department’s database to check whether a similar or identical mark has already been registered, and track the status of their applications. These can be done on the internet rather than making a trip to the Department, helping the applicants save both time and costs. Now, the trademark searching service by the Department of Intellectual Property is available online free-of-charge;- it used to be fee-based service at the rate of THB 100/hour.
With respect to the internal operations performed by the Department’s officials and employees, all tasks to be performed under the newly implemented workflow system, ranging from the trademark examination, forwarding instructions, publication of advertisements, handling oppositions and appeals, issuing official documents/correspondence, to registering changes to the existing records, and other relevant tasks, are paperless and supportive of work-at-home arrangement or, in other words, the Department’s officials can simply work anywhere and anytime. The new system also enables the issuing of notices of application result and certificates of registration through the use of E-signature module.
In addition, the Department’s new database has been designed to allow connection and exchange of information stored in the database of foreign trademark offices, the World Intellectual Property Organization (WIPO), and the ASEAN Economic Community (AEC), and to support the operations involving the international trademark registration under Madrid Protocol. To ensure stability and non-disruption of service provision, the expanded capabilities of the new system also include the contingency system in case of emergency or catastrophic disaster (DR-Site).
The Department of Intellectual Property is hopeful that, after the implementation of the new management system and workflow process specifically designed for trademark registration, the Department’s services would be more convenient, timely, and cost effective to all trademark owners and the public. Our services are in the process of transitioning to e-Government system which would eventually result in improved efficiency in serving the State and the public.
